This Privacy Policy explains the policies of the Joyce Theater Foundation (the “Joyce”) with respect to the Joyce’s collection and use of Personal Information (as defined below), including, but not limited to, Personal Information collected through each of www.joyce.org (the “Website”) and any related URLs (each and collectively, as appropriate, the “Platform”), how such Personal Information is used, and the circumstances under which such Personal Information may be shared and disclosed. This Privacy Policy is incorporated into, and is part of, the Joyce’s Terms of Use which govern your access to the Platform and/or your use of the Platform and of the Content (as defined in the Terms of Use). This Privacy Policy constitutes a legally binding agreement between you and the Joyce that conditions your use of the Platform, where and as permitted by applicable law. This Privacy Policy describes your privacy rights and how you are protected under privacy laws. 

By using the Platform, you hereby consent to the collection, use, sharing, storage and disclosure of your Personal Information in accordance with this Privacy Policy. Please do not access or use the Platform if you do not consent to the collection and use of your Personal Information as outlined in this Privacy Policy.

Collection and Use of Your Personal Information

Information We Collect

When using the Platform, you may be prompted to provide us with Personal Information used to contact or identify you. The Joyce collects the following nonpublic personal information (“Personal Information”) through the Platform:

  • Usage Data (Internet Protocol (IP) address of computers accessing the site; web page requests; referring web pages; browser used to access site; and time and date of access) 
  • Name
  • Email
  • Mobile Number
  • Work Address
  • Home Address
  • Health information related to visual impairment requirements or disability seating
  • Credit Card Information 

How the Joyce Collects Information

The Joyce collects and receives Personal Information from you in the following manner:

  • When you complete a registration form, purchase a ticket, make a donation or otherwise submit your Personal Information.
  • When you interact with the Platform.

Your Personal Information is stored on the Joyce’s secure database server and will be retained for as long as necessary to provide you with the Joyce’s services. Your Personal Information may be retained for longer periods for reporting or record-keeping in accordance with applicable laws. Information which does not identify you personally may be stored indefinitely.

How the Joyce Uses Your Personal Information

The Joyce may use your Personal Information for the following purposes:

  • Providing and maintaining the Platform, as well as monitoring the usage of the Platform.
  • Managing your account. Enabling access to multiple functions of the Platform that are available to registered users.
  • To contact you. To contact you by email, phone, SMS, or another form of electronic communication related to the functions, products, services, or security updates associated with the Platform when necessary or reasonable.
  • To update you. To update you with news, general information, special offers, new services, and events.
  • Marketing and promotional initiatives. The Joyce will use non-specific information gathered from you in order to improve the Joyce’s marketing efforts.
  • Targeted advertising. To improve advertising efforts that are relevant to your specific interests.
  • Managing customer orders. To process and manage ticket orders purchased through the Platform.
  • Managing donations. To process and manage donations made through the Platform.
  • Testimonials and customer feedback collection. If you share a testimonial or review about your experience using the Platform, it will be shared or otherwise used on the Platform.
  • Administration information. To administer the Platform.

How We Share Your Personal Information

Your privacy is important to us. The Joyce does not disclose any Personal Information to nonaffiliated third parties except as outlined herein.

Credit card information is not shared. The Joyce will not share Personal Information of those who make a donation. However, if donors are also Joyce ticket buyers, certain Personal Information may be shared as detailed in the “Third-party Sharing” section unless the Joyce is instructed not to share such information.

Tickets to some performances sold via the Platform are presented by other organizations. When a Joyce patron purchases a ticket for such a performance, their name, postal address, and email address information may be shared with the organization presenting that performance to fulfill the ticket purchase.

When purchasing tickets to Joyce events performed at a venue other than the Joyce, users may be redirected to a third-party website (any web page that does not contain “joyce.org” in its URL). Please refer to such third-party website’s privacy policies, for which the Joyce is not responsible.

Third-party Sharing

Any third-party with whom we share your Personal Information must disclose to the Joyce the purpose for which they intend to use your Personal Information. Such third party must retain your Personal Information only for the duration disclosed when requesting or receiving said Personal Information. The third-party service provider must not further collect or use your Personal Information except as necessary to perform the specified purpose.

Your Personal Information may be shared with a third-party for reasons including:

  • Analytics. Tracking and analyzing website traffic through online analytic tools.
  • Marketing. Generating and sending newsletters, marketing efforts, advertisements, promotional materials and more. Names and postal addresses may be shared with third parties (generally local cultural institutions) for mailings of promotional materials unless the Joyce is instructed not to share such information. 
  • Improving targeted advertising campaigns. Targeted advertising campaigns.
  • Payment processing and recovery services. Processing payments in the event of a purchase, refund, or other similar request.

Your Personal Information may be disclosed for additional reasons, including:

  • Complying with applicable laws, regulations, or court orders.
  • Responding to claims that your use of the Platform violates third-party rights.
  • Enforcing agreements you make with us, including this Privacy Policy.

Cookies

Security

The Joyce uses commercially reasonable efforts to ensure that Personal Information is kept secure and safe from any loss or unauthorized disclosure or use. However, because the Joyce cannot guarantee the security of the Personal Information you provide, you access the Platform at your own risk.

The Joyce is not responsible for the performance of websites operated by third parties or your interactions with them. When you leave the Website, the Joyce recommends you review the privacy practices of other websites you interact with and consider the adequacy of those practices.

Why we collect information about you

We will use one of the permitted grounds under the General Data Protection Regulation (including as such law forms part of the law of the United Kingdom) (“GDPR”) or other applicable law to process your information. The legitimate interests to collect your Personal Information may include any of the purposes identified above and any other purpose where we or a third party have determined that you have a reasonable expectation for us or a third party to collect or use your Personal Information for such purpose. You have the right to object to the use of your Personal Information for direct marketing purposes.

The categories of personal data we may collect will depend on the nature of our relationship with you and the purpose for which information is being collected. Due to the international nature of our business, your personal data will be transferred to countries outside of the European Economic Area or United Kingdom, such as to jurisdictions where we or our clients conduct business or have a service provider, including countries that may not have the same level of data protection as that afforded by GDPR or other data protection rules applicable to us (collectively, “Data Protection Law”).

In these circumstances, we take steps to ensure that the recipient agrees to keep your information confidential and that it is held securely in accordance with the requirements of Data Protection Law, such as by requesting appropriate contractual undertakings in our legal agreements with recipients.

We will, from time to time, review the purpose for which we have collected information about you and decide whether to retain it, update it, or securely delete it, if the information is no longer required.

What are your rights?

You have certain rights under Data Protection Law in respect of the personal data we hold about you and which you may exercise. These rights are:

  • to request rectification of inaccurate or incomplete information;
  • to request erasure of your information (a “right to be forgotten”);
